A federal magistrate judge on Monday dismissed the case against two former FBI officials who had been accused of lying to Congress, according to CNN. The charges grew out of a Republican-led examination of whether FBI investigators played down allegations involving the Biden family and material tied to Hunter Biden's laptop.

Magistrate Judge Zia Faruqui announced the dismissal during a hearing, telling the court he was "deeply troubled" by how the matter had unfolded, CNN reports. He said the prosecution rested on assumptions and had been brought at the direction of President Donald Trump.

The judge also said the case could only be understood as "weaponization," and that it had become "marketing material for people not to join the FBI," according to CNN.

Why it matters

The ruling closes — at least at this stage — a prosecution that critics had cast as politically motivated. It also puts a judge on record accusing the Justice Department of pursuing a case at the president's behest, a notable statement from the bench about the boundaries between law enforcement and politics.

The case had also drawn attention because of its timing. The initial charges were filed less than two weeks before Election Day, CNN reports, a detail that featured in the scrutiny surrounding the prosecution.

Who was charged, and why

The defendants were Nikki Floris and Bradley Benavides, both formerly senior intelligence specialists based in Washington, according to CNN. Each faced a single count of making a false statement.

Their statements at issue were made to the House Judiciary Committee in 2023, CNN reports. At the time, Republicans on the panel were questioning how an FBI task force focused on election interference had handled matters related to the Hunter Biden investigations.

After the first charges were brought, prosecutors added an obstruction count. According to CNN, that additional charge had not been signed by a judge or a law enforcement officer.

Faruqui presided over several days of argument on the charges before issuing Monday's decision, CNN reports. His conclusion was that the case lacked probable cause.

A judge's criticism of the prosecution

The magistrate's remarks went beyond the legal technicalities. In announcing the dismissal, he questioned the foundation of the government's theory and the motives behind bringing it, CNN reports.

His characterization that the case amounted to "weaponization" is a direct challenge to the Justice Department's handling of the matter. His comment that the prosecution had become a recruitment deterrent for the bureau suggests he viewed the fallout as damaging to the FBI itself, not merely to the two individuals charged.

The Justice Department had earlier described the defendants as officials it believed had hindered a corruption investigation connected to the Biden family, CNN reports. The dismissal means that theory was not sustained in court.

What to watch

It is not yet clear whether prosecutors will seek to revive the case or appeal the dismissal. Watch for any filing from the Justice Department in the coming days, and for whether the judge's criticism of the prosecution's origins prompts further scrutiny of how the charges were authorized.
